Eric Louca

Eric is an Executive Lawyer within our firm and he holds Bachelor of Business and Bachelor of Laws degrees. He was admitted as a Solicitor in 1999.

Eric is an experienced commercial lawyer with particular legal expertise in the automotive industry, franchising law, trade practices law, intellectual property and general contract law.

Eric advises numerous international automotive importers and distributors.

Eric’s practice is focused on the following areas:

• Drafting and advising in relation to dealer agreements and franchise agreements
• Reviewing and advising on disclosure document requirements under the Franchising Code
• Vetting automotive advertisements (including press, TV, radio and online) to ensure compliance with the Competition and Consumer Act 2010 (Cth) and the ACCC Pricing Manual for the Motor Vehicle Industry
• Advising on trade practices law, including the key areas of restrictive trade practices, cartel provisions, component pricing, resale price maintenance, misuse of market power, and misleading and deceptive conduct
• Drafting and advising in relation to automotive sponsorship agreements and automotive ambassador agreements
• Drafting vehicle loan agreements
• Dealing with disputes between franchisors and franchisees under the mandatory mediation process prescribed by the Franchising Code
• Advising in connection with tenders, and
• General contract drafting and advisory.
