Where possible, we’ll help you to avoid the need for litigation. But if it’s unavoidable – or the best option – we’re the people to choose to go to bat for you.
Insurance disputes
Clinch Long Letherbarrow assist insurers and those who hold insurance with all aspects of insurance disputes.
We have extensive experience helping our clients to secure a favourable result – often without the need for litigation.
With substantial skills in this area, we are able to carefully review the circumstances of the claim and make an informed recommendation regarding the course of action that we believe will generate the most favourable outcome for our client.
Acting on behalf of insurance companies
When acting for insurers, we begin by making a realistic assessment of the merits of the claim and estimate the reserves that the insurer should set aside, should the maximum amount of the claim be payable. We advise on the costs associated with conducting and defending the claim, as well as costs associated with underwriting and claims management decisions. In the event that litigation ensues, we conduct all aspects of running the case.
In circumstances where an insurer pays out on a claim, we are also experienced in seeking to recover the loss from a third party where a case for contributory responsibility can be made.
Acting on behalf of the insured
Clinch Long Letherbarrow also acts on behalf of insured people who wish to make a claim against their insurer. In this situation, we help frame their claim for indemnity under the policy, and assist with the preparation of reports in relation to liability or responsibility, as well as represent the claimant in any action taken.
