Where possible, we’ll help you to avoid the need for litigation. But if it’s unavoidable – or the best option – we’re the people to choose to go to bat for you.
Clinch Long Letherbarrow are highly skilled in assisting clients with all aspects of debt collection.
For clients who are debtors, it is vitally important to have terms of trade that help to avoid debt collection problems in the first place. We offer expert advice in this important area, including the drafting of contracts and guidance regarding payment processes.
Where bad debts do exist, we begin by identifying strategies that help clients to collect debts without the need to proceed to litigation, saving them considerable time, expense and inconvenience.
We are also experienced in alternative debt recovery processes, and where required, we offer a full litigation service in relation to debt recovery in whichever jurisdiction is relevant to our client, including local, district or supreme courts. We can also help with registering and enforcing judgments from other states or countries.
In making our recommendations to clients, we take into account the size of the debt in dispute, the degree of difficulty and expense likely to be incurred in securing its payment, and the likelihood of the creditor being able to pay the debt. In this way, our clients have a clear understanding of the probable outcome of various courses of action and can make a fully informed decision about the best path to take.
Clinch Long Letherbarrow also assist clients who have been issued with a Statement of Demand under the Corporations Act Section 459E. In this instance we can assist with applications to pay debts by instalments if this is the preferred route.
